城市化背景下农民集体土地所有权实现方式研究
摘要
中国城市化的时代背景决定了中国农村集体土地所有权继续存在的必要性。原因在于不论从国家角度，还是从农民角度，当前中国农地属性的价值排序中社会属性都应优先于经济属性，而集体土地所有权恰恰能够保证土地的社会属性得以发挥。然而我国集体土地所有权仍存在一些弊端，表现为集体土地处分权制度的模糊性。因此，需要在集体内部形成保护农民个体利益的合力机制，在集体外部建立具有约束性的土地用途评价机制，从而使中国农地真正走出集体困境。
土地问题是“三农”问题的核心，我国农民集体土地所有权的实现与农村经济发展、农民利益及“三农”问题的解决息息相关，城市化背景下农民集体土地所有权研究引起了学术界诸多研究者的关注。基于此，本文采用文献研究法，从农民集体土地所有权理论出发，分别阐述城市化背景下农民集体土地所有权的实质、农民集体土地所有权的内容、农民集体土地所有权实现途径。

Abstract
The background of China's urbanization determines the necessity of the ownership of rural collective land in china. Because no matter from the national point of view or from the perspective of farmers, the Chinese farmland property value of the sort of social attributes should priority on economic attribute and collective land ownership is precisely to ensure the social attributes of the land can be fully brought into play. However, there are still some defects in the collective land ownership in China, which is manifested as the fuzziness of the system of the right to dispose of the collective land. Therefore, it is needed to form a joint force mechanism to protect the individual interests of farmers in the collective, and to establish a binding land use evaluation mechanism in the collective.
The land problem is the core of the "three rural issues", is closely related to the solution of China rural collective land ownership and the realization of the rural economic development, the interests of farmers and the problem of "agriculture, countryside and farmers", under the background of urbanization farmers collective land ownership of caused the attention of academia, many researchers. Based on this. In this paper, the literature research method, starting from the theory of peasant collective land ownership, are discussed under the background of urbanization farmers collective land ownership, the essence, the rural collective land ownership and peasant collective land ownership realization way.
